The 118th SEAC considered the proposal for revalidation as per the Judgment dated.02.11.2020 in WP(C) No.17533/2020 and 23 other cases. The Proponent and Consultant were present. the consultant made the presentation, The Committee directed the Proponent to submit certain additional documents. The Hon’ble High Court of Kerala, in Cri.MC No.1232/2021 vide order dt.25-3-2021, has directed SEIAA to take a fresh look at the matter in the wake of the torrential rains and devastating floods which the State faced, after issuance of the EC dt. 25-10-2017 and suggest measures to be taken and additional conditions if any, to be complied with, for operating the quarry in question. Since there is a specific direction of the Hon’ble HC with a time limit, it is decided to entrust Dr.R.Ajayakumar Varma and Dr.A.V.Raghu for Field Inspection. These facts may be brought to the notice of SEIAA and the Standing Counsel with a request to seek extension of time limit for three months from the Hon’ble HC in this regard. The Proposal was placed in the 121st SEAC meeting. As per the direction from the Hon’ble High Court, the Sub-Committee entrusted with the field inspection scheduled the field inspection for 29.04.2021 but with the spread of Covid-19 Pandemic,it is desirable to postpone the field visit.Hence, the Committee requested SEIAA to seek extension of time for 3 months. The proposal was placed in 122nd SEAC and ratified the action of the Chairman, SEAC in sending the interim report to SEIAA due to legal emergency. The 123rd SEAC Meeting, Committee noted that the Interim Report in this regard has been submitted to the Hon'ble High Court of Kerala and decided to await further orders. The 112th SEIAA Meeting Authority decided the following: a. SEAC shall comply with the decision of the 110th meeting of SEIAA intimated to SEAC already as per letter dated 15.07.2021 on priority. b. The present status of the Crl.M.C. No. 1232 of 2021 shall be ascertained from the Standing Counsel, SEIAA and take follow up action as required. |
