The proponent vide letter dated 30.10.2019, requested to grand status-quo and extension of validity of existing Environmental Clearance through the process of ToR. 99th SEIAA noticed that when original EC was granted there is no requirement of EIA study and Public Hearing. However based on the NGT Order dt. 04.09.2018 the applicant has to carryout EIA study as the project area is greater than 5 ha. As the preparation of EIA report and public hearing takes time and the EC period is expiring on 26.11.2019, Authority decided to extend EC for 6 months from the date of expiry of EC. The project proponent shall carryout all the required exercises within this period and no more extension will be given. In the mean time SEAC may conduct a field visit to ascertain whether there is any violation of EC conditions, if so suitable recommendations shall be made while recommending for extension of EC. 100th SEIAA decided to issue orders correcting the survey numbers as requested by the proponent. 110th SEAC decided to brought to the notice of SEIAA that the corrections made by the proponent in the Mining Plan as mentioned by the Complainant is factual. 103rd SEIAA also taken a serious note of the observations made by the SEAC. Authority decided to forward the photocopies of the both Mining Plans with annexures to the Director, Mining & Geology througha special messenger for a complete verification of both the Mining Plans and to give a detailed report on the frauds/irregularities committed by the proponent within 7 days, with proposed actions against the persons responsible for such frauds/irregularities. A copy of the complaint from Sri.Sakeer Hussain.A may also be enclosed to the covering Letter addressed to the Director, Mining & Geology. 111th SEAC decided to furnish the copies of two mining plan to the District Geologist, Thiruvananthapuram Authority (104th SEIAA) noted that, in response to the SEIAA letter dated 07.03.2020 relating to fraud committed by proponent in the Mining Plan submitted for EC extension, the Director of mining and Geology via e-mail dated 18.06.2020, has reported that some fraud has been committed in the Mining Plan and for further investigation the matter has been reported to Police Vigilance. Authority decided to wait forthe final report fromthe Director of Mining and Geology for taking further decisions in this regard. In the meantime, Authority also decided not to give further extension sought by the proponent. The 112th SEAA Meeting Authority noted the above developments and decided the following: 1. Ascertain the latest position of case in NGT and take steps to defend the case through standing Counsel. 2. As requested by police department hand over the photo copies of relevant files to an authorized police officer on acknowledgement. |
